CBI FILES A CHARGESHEET AGAINST THEN CHIEF ENGINEER


New Delhi, 26.09.2017 The Central Bureau of Investigation has today filed a chargesheet against then Chief Engineer, Noida/Greater Noida Authority; his family members including wife, two daughters, son, daughter-in-law; a Chartered Accountant; three private firms (through their authorised representatives) and a Charitable Trust (through their trustees) U/s 120-B, 109 of IPC and Section 13(2) r/w 13(1) (e) of PC Act 1988 & substantive offences thereof in the Court of Special Judge, CBI Cases, Ghaziabad (Uttar Pradesh) in Disproportionate Assets case. Investigation also revealed that during the check period from 01.04.2004 to 04.08.2015, then Chief Engineer and his family members were found in possession of disproportionate assets(DA) worth Rs.23,15,41,514/-(approx) which was disproportionate to the extent of 512.66% to his known sources of income. Investigation also revealed that then Chief Engineer and his family allegedly incorporated 03 private limited companies, 03 proprietary firms and 01 charitable trust to convert the black money into white. Income shown in these companies/firms were allegedly found to be managed through accommodation entries after providing equivalent amount of cash through batteries of CAs in various manners, like money routed showing as unsecured loan, share application money, selling of shares at premium. It may be recalled that CBI had registered a case on 30.07.2015 u/s 109 of IPC r/w 13(2) r/w 13(1)(e) of PC Act 1988 against then Chief Engineer, NOIDA/ Greater NOIDA Authority (UP); his family members and his business associates in compliance of orders dated 16.07.2015 of Hon’ble High Court of Allahabad, Lucknow Bench in Misc. Bench No. 12396 of 2014 on the allegations of acquiring huge assets which were disproportionate to his known sources of income. Searches were conducted during August, 2015 at the premises of accused persons at 16 locations including at Noida, Agra and Lucknow. During the searches, it was found that then Chief Engineer was allegedly having 03 immovable properties; his wife having 19 immovable properties and son having 3 immovable properties. It was also revealed that jewelllery worth Rs. 1.04 crore(approx) was allegedly purchased during the check period by the family of then Chief Engineer. The public is reminded that the above findings are based on the investigation done by CBI and evidence collected by it. Under the Indian Law, the accused are presumed to be innocent till their guilt is finally established after a fair trial.
